Downloading case in the High Court



Four-spot criminal record companies have brought a Heights Court natural action to compel Eircom - the State's largest broadband service supplier - to prevent its networks existence used for the illegal downloading of music.
It's the first caseful to be aimed at the service provider quite than at mortal illegal downloaders.
The four record companies taking the action at law ar EMI, Sony BMG, Universal Music and Warner Music.
Willie Kavanagh, Managing Music director of EMI Hibernia and President of the Irish Gaelic Recorded Music Association, said because of illegal downloading and other factors, the Irish music industry was experiencing a "dramatic and accelerating decline" in income. 
He said sales in the Irish people market dropped 30% in the six days up to 2007.
EMI and the other companies are challenging Eircom's refusal to use filtering applied science or other measures to voluntarily block or sink in lawlessly downloaded material.
End October Eircom told the companies it was non in a stance to consumption the filtering software program.
Eircom as well told the companies that it was not on notice of specific illegal natural action which infringed the companies' rights and it had no legal obligation to reminder traffic on its network.
